Luscious does not include any cutlery or silverware; plates, napkins, linens within this quoted event. These items are available for an additional fee.

Payment Schedule

Deposit will serve to hold your place on the Luscious calendar.

Any additional unforeseen expenses or any un-needed expenses will be provided for approval in writingAny adjustments will be made as they arise with both parties in agreement

There is a 3.5% service fee on credit card and PayPal payments

Cancellation Policy Catering Events – Special Events

 

Should it become necessary for the Client to terminate this Agreement, and the event date is greater than thirty (30) days, The caterer shall be entitled to retain any and all expenditures to date, including but not limited to contracted labor, special orders, rentals and/or proposals costs.

 

If Agreement is terminated within thirty (30) days of the event, Caterer shall be entitled to retain twenty-five percent (25%) of deposit and downpayment and seek any additional expenditures to date, including but not limited to contracted labor, special orders, rentals, and/or proposals costs.

 

If Agreement is terminated within fourteen (14) days of the event Caterer shall be entitled to retain any deposit paid and seek any additional losses including but not limited to contracted labor, special orders, rentals and/or proposals costs.If an Agreement is drawn within five (5) days of the event, Client agrees to pay full event costs per bid.

 

Should the event be cancelled by Caterer, Caterer will fully refund any deposit within ten (10) days of the date of cancellation. If event is within thirty (30) days, Caterer will reimburse or pay to Client the invoiced difference in costs and expenses that have been incurred by the Client paid to an alternative provider or providers based upon the total proposal bid. Client shall make reasonable efforts to mitigate damages and obtain substantially similar services. The caters responsibility is limited to items covered in the last accepted proposal by Client. Any additional items are at Client’s expense.

Indemnification and Hold Harmless

 

Client agrees and by their signature(s) to indemnify and hold harmless Caterer in the event more guests attend the event than guaranteed to Caterer, or if not enough foods, beverages or services are ordered to properly serve the attendees. Client further agrees to indemnify and hold harmless Caterer for any foods or beverages removed from venue by any person or persons whatsoever and consumed or transferred to another person, persons or organizations whatsoever, and consumed which causes sickness and any or all conditions leading up to and including death. Caterer may only be held liable in the event gross negligence is determined through adjudication. Client understands that all foods leftover from an event on displays cannot be packed for them without paying an additional fee for servers or culinary to handle. This must be discussed before the event is executed with the Luscious, nibbles and nosh representative.

Insurance

 

Client and Caterer agree to carry, or cause to be carried, liability insurance to cover any and all damages arising out of any act of gross negligence.
